Terms of Service

These Terms of Service ("Terms") govern your use of PromoteIt's website, iOS app, and related services (the "Service"). The Service is operated by Einar Skautrading as PromoteIt ("PromoteIt", "we", "us"), based in Sweden. Contact: einar.skau420@gmail.com. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Who can use PromoteIt

You must be at least 18 years old and able to form a binding contract. If you use PromoteIt for a company, you represent that you are authorized to bind that company. Accounts are personal or organizational. Do not share login credentials.

2. The Service

PromoteIt is a marketplace that connects brands and creators for paid TikTok sound promotions (music / audio campaigns). Brands create campaigns and fund escrow. Creators browse or apply, join campaigns, post with the campaign sound on TikTok, submit public TikTok video URLs, and after brand approval receive payouts to an in-app wallet, withdrawable via Stripe Connect.

PromoteIt provides marketplace tools (escrow, applications, review, messaging, wallet). Except where we expressly say otherwise, we are not a party to the creative deal between brand and creator, and we are not affiliated with TikTok or ByteDance.

3. Accounts & roles

  • Provide accurate information and keep it updated (including payout details).
  • Creators must connect a real TikTok username before using marketplace features. You are responsible for that TikTok account and for deliverables you submit.
  • You may delete your account in the app (Profile or Payments → Delete account), subject to finishing open work and withdrawing any wallet balance first. We may suspend or terminate accounts for fraud, abuse, illegal content, chargebacks, or Terms violations.
  • You may report or block other users; we may act on reports at our discretion.

4. Campaigns, escrow & fees

  • Funding.Brands must fund escrow (campaign budget plus the platform fee and any payment-processing costs shown at checkout) before creators can complete paid work on that campaign. Payments are processed by Stripe Checkout. This is payment for a real-world promotional service, not an in-app digital good purchase under Apple's In-App Purchase rules.
  • Fees. PromoteIt charges a platform fee (currently disclosed in-product and at checkout, typically a percentage of campaign budget). Card processing fees charged by Stripe may also be passed through as shown at checkout. Taxes you owe (VAT, income tax, etc.) are your responsibility.
  • Approval & payout.When a brand approves a submission, the agreed creator payout is credited to the creator wallet against escrow. Creators withdraw via Stripe Connect subject to Stripe's terms, identity verification, and payout timing (often several business days to reach a bank).
  • Rejection & revisions. Brands may reject or request changes consistent with the brief. Creators may appeal or resubmit where the product allows.
  • Cancellation & refunds. Brands may cancel campaigns under in-app rules. Pending reviews may be auto-handled as described in the product. Unused escrow may be refunded subject to Stripe timing and fraud checks. Fees already earned by PromoteIt for completed work are generally non-refundable.
  • Disputes. Brand–creator disputes should first use in-app messaging and review tools. PromoteIt may, but is not obligated to, mediate. We may freeze funds or reverse credits in cases of clear fraud or Terms violations.

5. Content, license & disclosures

  • Creators must own or have all rights needed for submitted content, and must follow TikTok rules and applicable advertising law (including paid partnership / #ad disclosures where required).
  • By submitting a deliverable, the creator grants the brand a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that deliverable for promotional purposes related to the campaign brief, unless the campaign states otherwise in writing.
  • Brands may upload campaign media (for example cover images or audio references). You must have rights to that media and grant PromoteIt a license to host and display it in the Service for campaign operation.
  • You must not submit illegal, infringing, hateful, sexual involving minors, or otherwise harmful content. Do not impersonate others or submit another person's work as your own.
  • Brands are responsible for campaign briefs, music/rights clearances they control, product claims, and that promotions comply with law in markets they target.

6. Acceptable use

You may not: abuse the Service; scrape or reverse engineer except as allowed by law; bypass fees or escrow; manipulate applications, views, engagement metrics, or Trust Score; harass others; or use the Service for money laundering, sanctions evasion, or other illegal activity.

7. Third-party services

The Service integrates third parties such as Stripe, TikTok (public profile/video metadata and oEmbed previews), Google Sign-In, Sign in with Apple, email delivery, push notifications (Apple), and hosting. Their terms and privacy policies apply to their services. Outages or policy changes on TikTok or Stripe may affect campaigns and payouts; we are not liable for those third-party platforms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee campaign results, creator performance, brand payments beyond escrow mechanics, or uninterrupted availability.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMOTEIT'S TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID TO PROMOTEIT IN THE THREE (3) MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST PROFITS DAMAGES. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent allowed.

10. Indemnity

You will indemnify and hold PromoteIt harmless from claims arising out of your content, campaigns, misuse of the Service, or violation of these Terms or applicable law.

11. Changes

We may update these Terms. We will post the new version with an updated date. Continued use after changes means you accept the updated Terms. Material changes may also be communicated in-app or by email when practical.

12. Governing law

These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules. Courts of Sweden have exclusive jurisdiction, except that you may have mandatory consumer protections in your country of residence.
